Terms of Use

1. Purpose

These Terms of Use govern access to and use of the paktPot platform (hereinafter “the Service”), available at www.paktpot.app.

paktPot is a tool for formalising agreements between poker players (staking, swaps, last longer, ICM deal, prop bet, custom agreement). It allows these agreements to be created, signed electronically and tracked.

2. Acceptance of the Terms

Use of the Service implies full and unreserved acceptance of these Terms. If you do not accept them, you must not use the Service.

3. Account creation

Access to the Service requires creating an account. When registering, the user undertakes to:

  • Provide accurate and up-to-date information
  • Keep their credentials confidential
  • Immediately notify paktPot of any unauthorised use of their account
  • Be a natural person of legal age or a duly authorised legal entity

An account is tied to an email address and may not be transferred to a third party.

4. Description of the Service

paktPot allows users to:

  • Create poker agreements (deals) by defining the participants, types and terms
  • Invite other users to sign these agreements by email
  • Electronically sign agreements as a participant
  • Make counter-proposals or decline an agreement
  • Close an agreement, request early termination, or open a dispute
  • Generate timestamped, verifiable PDFs of signed agreements
  • Verify the authenticity of an agreement through a public cryptographic fingerprint

5. Legal value of the agreements

Agreements created on paktPot constitute commitments between the signing parties. The electronic signature applied on the platform evidences each participant's consent.

paktPot is not a party to the agreements concluded between users and does not take part in their performance. In the event of a dispute between participants, paktPot provides the evidence (signed PDF, cryptographic fingerprint, timestamp) but plays no role as arbitrator.

The legal value of the agreements depends on the legislation applicable in the users' country. paktPot does not guarantee that these agreements will be recognised before any given jurisdiction.

6. User obligations

The user undertakes to:

  • Use the Service in accordance with these Terms and applicable law
  • Not create fictitious, fraudulent or abusive agreements
  • Not impersonate another user
  • Not attempt to compromise the security or integrity of the Service
  • Respect the rights of other users

7. paktPot's liability

paktPot undertakes to provide the Service with care and diligence. However, paktPot cannot guarantee continuous availability of the Service and disclaims all liability for:

  • Temporary interruptions of the Service for maintenance
  • The consequences of an agreement between users not being performed
  • Indirect damage related to use of the Service
  • Data loss resulting from an event of force majeure

8. Personal data

The processing of users' personal data is described in our Privacy policy.

9. Intellectual property

The Service, its code, its interfaces and its brand are the exclusive property of paktPot. The user acquires no ownership rights over the Service. Content created by users (agreement titles and terms) belongs to them.

10. Termination

Users may delete their account at any time from their profile settings. paktPot reserves the right to suspend or delete an account in the event of a breach of these Terms, without notice.

Termination does not affect ongoing agreements involving other participants.

11. Changes to the Terms

paktPot reserves the right to amend these Terms at any time. Changes take effect as soon as they are published on the site. Continued use of the Service after a change constitutes acceptance of the new Terms.

12. Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the courts of Nantes.

This document was drawn up in French. In the event of any discrepancy between language versions, the French version prevails.
